תושב אשדוד הכה את אשתו חנק את ילדתו ויצא בעבודות שירות בלבד

אשדודי בן 61 סטר, הכה וגרם חבלות לאשתו בגלל שהסתמסה עם גבר אחר. באישום אחר הוא חנק את ילדתו בת ה12. עורך דינו גל סילברמן הצליח למחוק את אישום החניקה והוציא אותו בעבודות שירות בלבד בתיק החבלות לאשתו.

כתב אישום ובו שני אישומים בגין אלימות במשפחה הוגשו כנגד תושב אשדוד בן 61 לאחר שבמקרה הראשון ראה את אשתו שותה וודקה ומסתמסת עם גבר אחר.

על פי כתב האישום, הוא סטר לה בפניה, הכה אותה והפיל אותה על הרצפה תוך כדי שהוא גורם לה חבלות בגופה. לאחר מכן הוא הוציא אותה מהבית ותלש לה תיק שהיה תלוי על כתפיה כל זאת לעיני ילדתם בת ה12.

באישום השני הוא הואשם בכך שחנק את ילדתו בת ה12 לאחר שהיא העידה על כך בפני חוקרי המשטרה. בשני המקרים הוא הואשם בתקיפה הגורמת חבלה של ממש.

עורך דינו גל סילברמן טען בפני הפרקליטות שעדות קטינה זקוקה לתוספת ראייתית מסוג סיוע כגון חבלה וכדומה מה שלא נמצא על הקטינה. הפרקליטות קיבלה את טענותיו והאישום בגין חניקת הקטינה נמחק לחלוטין.

בתיק האלימות כנגד אשתו הוכיח עו"ד סילברמן כי יש סתירות בעדותה של המתלוננת והוציא את הנאשם עם עבודות שירות בלבד ללא תזכיר וללא שיקום.
